Check Not Received; They Want to Charge Us for the Stop Payment

My question involves a consumer law issue in the State of: Michigan.

Nursing home grandmother was in sent us a letter stating they owe us a refund.

We still have not received the check. Called, they sent it. They decided to put a Stop Payment on it, and issue a new check.

However, they are charging us the Stop Payment fee.

Is that legal?

Probably. What does the contract say? How long has the check been 'missing'?

Grandmother passed away 4/12. She'd been in the nursing home for less than a month.

Of course, they demanded payment immediately.

May 1, they sent us a letter stating we had a $4030.00 refund coming, that Medicare paid.

As of 7/13, the nursing home was just starting to process it.

As of 8/17, per phone call, the check had been mailed on 7/22. We never received it.

As of 8/31, it will now be another few more weeks because they have to cancel (stop payment) on the check.

The question is: They are charging US to put the stop payment on the original check that we never received. Is this legal? Since they sent us the check and it got lost someplace?

Mom has a question, too.

She read they should have issued the check within 30 days of the May 1st letter. Is this true?

Update: Check received. And they did not charge us the stop payment fee.
