Default Charges against person who stole checks
i'm in texas.

here's my question:
a few weeks ago, a friend of mine had her checkbook stolen from her purse. the same day, she called up her bank to cancel her checkbook. the bank said they would cancel those checks, and for her not to worry about it.

fast forward a couple of weeks, and my friend starts receiving mail from wal-mart saying that she purchased a 2000+$ television with a bad check and that they want their money. my friend calls up her bank and tells them what happened, and, again, they say not to worry about and that they'll fix the problem.

anyways, she goes in to get her driver's license renewed a few days ago, and she's taken off to a holding cell by the police for reportedly not paying for this television, which she didn't buy. she ended up getting out and not having any charges pressed against her, but what exactly can she do?

is there any method by which cops can find the person who stole her checkbook and wrote the bad checks? call me crazy, but if there's nothing that can be done, surely this method is entirely too easy to abuse by criminals.

If the police do find the person who stole the checks, it's pretty much a certainty that they will try to bring charges.

You have to remember that the "phanthom criminal" is one of the oldest stories in the book.

I suggest you get a good lawyer.

thanks for the responses!

and, while i know my integrity is questionable given my experiences with shoplifting items (which was the original reason i signed onto this board), i certainly was not the criminal mentioned in this case . i was, however, interested in how something like this could apparently be so easy to commit with very few limitations.
