    Default Both Names on Deposit Refund but Roommate Will Not Sign

    My question involves landlord-tenant law in the State of: KY

    I just moved out of a shared apartment with a roommate. Earlier in the year this roommate had sat a pan directly off of the stove and onto the counter top burning a fairly large hole in the counter. She commented to me that she would be responsible for any fees in regards to this. Upon move out we received an electric bill which I asked for her to leave me a check for half of the amount. She commented that she would like me to keep the entirety of the deposit to cover the bill. I replied that I doubted we would receive out deposit back due to damages. I set up the appointment with the complex to do the walk through and invited my roommate to come. She said she wasn't going to and I asked for a forwarding address for her so that the apartment could send anything they needed both our ways. She said that there was nothing that she would want forwarded to her new address. After the walk through with the apartment, we ended up not being charged for any damages and received our full deposit back. I tried to contact her to tell her that we would be receiving the deposit and discovered that she had blocked me from communicating with her on facebook, which had been our primary form of communication. Upon receiving the check I noticed that it had both our names printed on it. I have tried to contact her through calling, text, and email. None of which she will reply to. I cannot deposit the check without both of our names on it. I tried calling the landlord and asking if they would reissue a check for half of the amount in just my name and they refuse. I have paid the last electric bill completely on my own and now cannot even get my half of the deposit because she refuses to get into contact with me. Is there any action I can take?

    If it were me I would sue her in small claims court and see if that inspires her to sign the check. If not, I would go to court and seek a money judgment. It's a bit more complicated than it would normally be, given that you have a check in hand, but if she won't sign it perhaps the court will try to convince her to do so or order her to pay you money with her receiving the check (endorsed by you) after she pays.
