    Default Can I Benefit from a Waiver

    my vehicle was searched while crossing the border fron reynosa,tamp.mexico into hidalgo,tx.was found 20 kilos of cocain in the spair of my suv.at the time i was crossing the border twice a week selling american pickup trucks to mexican nationals.i was a permanent resident at the time and never had even a ticket before.i received my permanent card in 1995.my incident happed in 2004.well customs gave me a 10,000 dlls fine for violating the customs reporting requirements.i was detained by customs for three hours and released to immigration services were i was for three days.in the third day i was called by the jefe assitant and was pressured into signing voluntary departure with a 10 year ban.i did and was released that same afternoon.i returned to usa the next day.and have been here ever since.what changed?i did three years of taxes in a row and was deducted for the fine and interest.total about 12,000 dlls.i had a attorny do a federal,state and city background but nothing shows up.not even an arrest.applied for job and they used e-verify from ins website and it said i was authorized to work.what gives?what do i do next? i went to try to get my driver license but was told that although they had record of my old license that expired on 2005 and i even saw it on the screen,they needed my green card in order to renew or re-apply.the laywer i got was a criminal lawyer and not immigration so he told me to get a immigration lawyer.whats next?

    You were caught with 20 kilos of cocaine, and you weren't criminally charged? There must be a back story here.

    The USCIS knows what was in your car and, even without a criminal charge, that's what counts.

    You were apparently heavily involved in the drug trade and, if so, you should not expect that you will ever be permitted to lawfully enter the U.S., save perhaps for the limited purpose of testifying for the prosecution at a drug trial. If there are facts that might help you get a waiver, perhaps a lawyer can help you determine what they are - so far you certainly haven't shared any with us.

    i have just explained it just as it happened.also though back then i had an injury on worksite and wastaking by prescription three zanex,two somas and one zoloft a day.but since workers comp was cut i had to work and make money.i was sent to doctor when i was in ins detention almost immidiatly upon arriving.another thing is the drugs were found in the spare tire on the outside of suv and was accessible from outside with no lock or anything.something is amiss but what.did someone forget to do something?truthfully i was waiting for 15 to 20.

    ins official said i had a 10 year ban and seemed very upset about it.its on paper.no conviction.no sign of anything in my record.thats why i thought i could aply for waiver.and no i was not involved in smugling or anything to do with drugs.no even a user.i mean in my entire life.i dont even drink.i got an immigration lawyer now and i,ll see what happens and will keep you up to date.might help someone else.

    The INS official was likely upset that you were not permanently banned based on your apparent involvement in drug trafficking.

    It also appeared that you reentered after receiving the ban and have been living in the US since that time. This is generally a permanent ban. Nothing you have said indicates you are in any way qualified for a waiver. You need to consult an immigration attorney. Again: You need to consult an immigration attorney. No one on any forum can give you any better advice than that.
