Default Help wanted regarding repossession
Can someone point me in the right direction regarding my repossession. A few years ago me and my wife (currently ex wife) bought a car together. Both of our names where on the loan. A year after we bought the car she filed for divorce. The courts made me leave the house and took the car. The judge said I could not come near the car and it was hers until everything was settled in the divorce. The divorce took over a year to complete. The courts awarded her the car. A month after the divorce, she wrecked the car and had no car insurance. The loan was still in both of our names at the time. The credit company said I was still responsible for the loan because my name was the primary person. Is there anything I can do to remove this from my credit report? Do I take my ex-wife to court even though she has no money or anything of value? Do I try to come to an agreed settlement with the collection agency/creditor?

True. You remained on the loan; thus you remained liable for the loan.

If the report says you defaulted on the loan, that would appear to be an accurate entry. You should be able to add a short explanation to the entry, such that anybody seeing the report can get a very brief version of "your side of the story".

You can take your ex- to court; but if she can't pay a verdict, the judgment won't do you much good.

It couldn't hurt.

Did you have an attorney representing you during this period? Didn't the attorney advise you on the significance of having your name remain on the vehicle and loan? Or is this a situation where you couldn't get your name off of the loan, because your ex- lacked the resources to refinance the car into her own name? I wouldn't have advised this type of arrangement.

Hello,
If you are still in fact battling this issue. Contact this company. They negotiate all unsecured delinquent debt. You can refi your house or your wife's, negotiate this repo (delinquent debt) and pay everything off.
