    Default Mileage Taxed As Income

    My question involves employment and labor law for the state of: Ohio

    I work for a college as a part-time professor and I was assigned a post that required me to drive a great deal. I was told I would be reimbursed mileage at 0.50/mile which is below the state minimum. My mileage is now being taxed and I was told it is considered taxable income because I am not a full-time employee. Are they allowed to do this?? I don't know the IRS laws on this.

    WERE you reimbursed at fifty cents a mile or something else? The correct answer to your question is going to depend not on whether you are full or part time, but on how much you were ACTUALLY reimbursed (as opposed to what you were told your would be reimbursed).

    Are you being treated as an employee or a contractor? If you are a contractor ((without going into details as to the propriety of treating you as a contractor), then yes your mileage will be properly included in your 1099's. You'll just take it right back out as an expense off the top (provided you actually did have that expense).
