Injured after reports of unsafe work area ignored for months
[color=red][/color]I had reported unsafe work conditions for over 8 months, was even on safety commitee and reported it also but nothing was ever done and I was hurt in 2004. My boss did not talk to me for months and I recieved dirty looks for months also, they put me doing a light duty job in a office with my foot elevated, then they moved me to a office in the plant for a day , then they moved me in the plant, doing the same job( putting stickers on parts) next to a oven, with my foot elevated, then after 10 months they finally send me to a actual "foot" doctor for my foot, and I was scheduled for surgery, now I am out on leave from surgery, getting ready for cast to come off and I am wondering if the company can get away with not fixing a safety issue for 8 months and then I got hurt thurs and they fixed it saturday. The doctor says I have chronic pain, and that my foot could be numb for 6 months to a year, I have to do pt after my cast comes off, but I hurt so bad with nerve pain(my dr says thats what it is) I am scared, please tell me what you think :cry: :cry:

OSHA Complaint
Has the matter been investigated by OSHA, or your state's occupational safety administration?

I did not know that they would investigate it, do I call them and tell them what happened or not, also, it happened march 2004 and they fixed cracks 2 days later after us telling them for 8 months that our racks holding 72 by 84 inch glass rocked when we pushed them over it, but no one did anything about it until the rack got stuck in a crack and the end of it rolled over 1/2 my foot, now I have some nerve injury and just had surgery on it, in which after making me wait for over a year, taking pills for my pain,they discovered a messed up ligament and had to recontruct one. I cried for a whole year, as I sat at work in a made up job,on light duty, telling them I cant walk on it and a year later they decide to send me to a actual foot doctor and within months I am scheduled for surgery and they did find a problem, but I still have nerve issues I suffer with everyday. Please help me

Injured at Work
If your injury is being covered by workers' compensation, that's probably your exclusive remedy against your employer. You may wish to consult a local workers' compensation lawyer who also practices personal injury law, to see if there is a possible third party defendant or product liability claim.

workmans comp nurse
Hello, do I have to let the nurse come into my doctors office room when he is going to check me and tell me what he thinks? She has been coming in this whole time, on occasional visits and has never asked me and for my next visit in 3 weeks , the doctor is going to tell me if I can start pt, she told me i am on vac on that day but I might send someone. I got curious because yesterday when the doctor said we have to treat jen different because of her chronic pain, so we will see if pt can start in 3 weeks instead of now, she came out with, well just to remind you, she has an employer and they offer light duty. When I was on light duty all I ever heard from the plant nurse was light duty does not last forever, its not a job, we are helping you. So why after surgery, would they bring up the light duty? Can you help me. I know they have tricks up their sleeves and could you tell me what some might be>

Workers' Compensation Problems
It's not clear why the nurse is in the office room - perhaps as a chaperone? You may wish to consult with a local worker's compensation lawyer about your situation.

my doctor said
[color=darkblue][/color]My doctor said he would normally have people go into pt after the cast I had on came off, but the "way god made me" he is going to have me in a walking brace for 3 more weeks then if he clears me that day i have a pt appt for 1:00.
The workmans comp nurse then said , dont forget she can do light duty, ( she was in the office with me and the doctor which i recently found out that I dont have to let her in ) my question is , can they have me go to work with crutches in a factory where it is dangerous to even walk in the with shoes on let alone crutches.
My doctor is really listening to my complaints of electrical pains after my surgery and he said I have chronic pain and might have to live with the pain forever. Can a doctor send you to work with chronic pain , having to pop pills to get through the day?

The doctor can declare you fit for light duty work. Whether or not your employer has any light duty positions available consistent with your medical condition is not something the doctor controls.

A lot of people work despite having chronic pain conditions. The question becomes whether your condition is disabling in relation to your employment, and apparently your doctor has decided that it is not.
