Baby's Mom Hasnt Let Me See My Baby Since Was Born, Been a Month Now

My question involves paternity law for the State of: Oregon... My fiance n babys mother gave birth to my son a month ago, lied to me n didn't tell me when she was in the hospital and gave birth without me there. Since his birth i haven't seen him not even ONCE! She has kept telling me she's gonna lemme see my son n is going to come over, but every time shes never came over and just been lies. I did save some texts from her talking bout going out to bars n leaving my son at home with her mom or her sister n law, but wont let me ever c my son or be the one watching him. I'm always begging her to let me see my son and told her ill come to them or do whatever it takes to see my son. She wont tell me where shes living at with my son and everything been telling me have all been lies. I dont know what to do, I think she may b seein someone else but denies to the fullest and swears she loves me, we rly are soulmates n had a great relationship till lately. So i want to have hope that we're gonna get back together, so i dont want to take her to court but i also needa see my son, its killing me. Also i think im not even on the birth certificate, i kno she used her last name on the BC in hospital but is telling me thats not the official one and she hasnt turned in the official BC yet but claims will have me on it. What can i do to be able to see my son but be as civil as possible bout it not having to take it to court? What if things just got worse and i needed to take to court, whats the worse actions i can do to her to gain custody of my son? What stuff is she doing that i can make a legal action against? Please help me on this one, thanks

Unless you are legally established as father and get a court order for visitation, Mom doesn't have to allow visitation at all. Legally, you don't have a son at this point.

So, you need this (it's the fourth form down) to file for paternity.

And then you can file this packet to establish a parenting plan.

If you're not on the birth certificate - and you're not, since you two didn't fill out a Voluntary Acknowledgment of Paternity - you have NO rights to the child AT ALL until paternity is legally established.

I'm afraid that means you're going to have to avail yourself of the courts. Your first step is to begin an action to establish paternity. You can commence this action by filing an Application for Establishing Paternity through the Oregon Child Support Program.

After paternity is established, you can pursue a visitation order and arrange for child support.
