Re: My Ex Won't Leave - No Lease
She was not required to pay rent, just to help with chores and watch the children while I was at work. She doesn't even do that.
Evicting her is the only way to get her out if she refuses to leave willingly.
You are not necessarily evicting her for violating any agreement you had but simply terminating the tenancy. That still requires you to follow the law including providing formal notice with the legally required time allowed prior to termination. Given that there was no rent, determining whether this would be a month to month or some other period of time (week to week, annual), and I can find nothing classifying it, I would suggest treating it as a month to month (which is what many states do with an unspecified agreement) and utilize the time period prescribed for such. That would mean you would have to give her notice no less than 15 days before the end of any given month to terminate the tenancy at the end of that month. If she fails to leave by the first of the month, you would then file for an eviction with the appropriate court.
I am not an attorney and any advice is not to be construed as legal advice. You might even want to ignore my advice. Actually, there are plenty of real attorneys that you might want to ignore as well.
