We had a mortgaged car 3 years ago, and it was totally wrecked due to an accident. Unfortunately, the bank did not insured the vehicle for 3 months before the accident had happened. Now we lost the car because it cannot be repaired due to its huge damage. The bank is still asking for payment for the debt we owe, but how can we pay if we have no car at all? We consulted a lawyer and the case is still on going. The bank refuses that the obligation to insure the vehicle is theirs. All banks insures the mortgaged vehicle but they are not, and we don't understand why they don't when all banks insures the vehicle. What are the laws governing this kind of case? Who should be obliged to insure the car in the first place? Do we need to still pay the remaining debt?
