Buying a Home With Encroachments on a Power Company Easement

My question involves real estate located in the State of: Florida

Buying a Home built in 1981 and the Fence and Concrete Shed Encroaching the Power Co Easement in the back yard. It shows on the survey. Realtor and the owner say "shucks no big deal".

The closing is in 2 weeks.

Progress Energy has not had a problem yet.

Please advise.

You should ask the seller for the letter from the power company allowing the enchroachment. Absent that, you as the new owner could be (and very well may be ) told to move the building- and at your expense. The fence most of the time isn't a big deal. They can put in a gate. The building, if its been there less than 21 years will be up to you to move. The 21 years is not a hard and fast rule. If the seller wants to close tell them to provide the letter, move the building or take an amount off of the deal equal to you moving the building. Don't take the realator's advice or word on anything. HTH
