    Default How to Subpoena a Law Enforcement Officer to a TRO Hearing

    My question involves court procedures for the state of: California

    Which form should I use: SUBP-001 or SUBP-015?

    Are there any other forms I need or things I need other than taking these to the clerk for issue, and then serving? I am pro-per and this is for a DV TRO hearing.

    SUBP-015 is a subpoena for a deposition. SUBP-001 is a subpoena for a trial or hearing.

    You might also be required to put down a deposit with the employing agency that will cover the officer's time at an overtime rate of time and a half for at least four hours. In other words, you will be required to pay for the officer's court time (and most MOUs have a court minimum of 2 to 4 hours depending on the MOU).
