    Default Auto Interlock Contract

    My question involves collection proceedings in the State of: Arizona

    I was mandated by MVD to install an Interlock device for 12 months in 2007, I completed 6 months of the contract then was unable to continue so I disconnected the unit and returned it to the owner, there was a $275.00 early termination fee I was unaware of, I never received a bill for it but I do not dispute the money is owed, why he did not collect is anybodys guess.

    Fastforward 2011, I needed to install an interlock again mandated by MVD, I returnrd to the same company and did the installation .The company says it will hold up my certificate of completion if the old $275.00 is not paid with this new contract, my feeling is this is a New contract and that the two contracts have nothing to do with one another, I asked him to send a bill for the old balance due to my house, he does not want to. My argument is THIS HAS NOTHING TO DO WITH WHAT HAPPENED FOUR YEARS AGO......Thanks

    And your question is what?

    Whether a private company can decline to do business with you, or put restrictions on how it does business with you, if you fail to pay the money you owe to it?

    No, to satisfy the MVD requirement you need 12 months of interlock, so after 12 months he gives completion cert., he says (I think) even after I complete the 12 months

    he will hold my certificate due to the balance due from 4 yrs ago, that balance is a seperate issue, it was a seperate contract.He is not refusing to do business, we are now in a contract for 12 months, that past due balance is not part of current contract. See.

    If you believe he is in breach of contract, you can sue him. I expect that he will countersue for the money you owe to him. If you try suing for damages, you may get a refund - I expect you want the certificate; you can try suing for specific performance, but you can expect the lawsuit to be more costly and cumbersome to bring.

    Consult a local lawyer; a local lawyer may be able to suggest additional options.

    I would take him to small claims court if nesessary.My gripe is for 4yrs I never received a bill (I never changed addresses) now he want to link the contracts, they are two different situations, unrelated.I am not refusing to pay him, I just don't feel he has the right to essentially Hold my drivers license hostage for an unrelated past due matter that he refused to bill for.

    Issue resolved ! , I started and completed the 1 yr interlock mandate, worked out an agreement with the installer to add
    the balance owed which was $375 over the course of the new 1 yr contract.Not a big deal. Oh, no drinking = no warning lights !!
