    Default Non Custodial Parents Visitation Removed and Sole Custody Rights As a Parent

    My question involves a child custody case from the State of: NY


    I have sole custody of my four year old child.
    My daughters father has be awarded visitation every other weekend.
    Recently he has gotten married.
    Both him and his new wife have been making my life miserable.

    I have been wrongfully arrested for assault, of his wife.
    I have been reported to childrens social services for the second time.
    They both proceed to verbal abuse and argue with me during the pick-up/drop offs that occur at my home.
    The wife has attempted to attack me on two occasions.
    She has tried to run me over, again at another pick-up of my child.
    She has an order of protection against me and still comes to my home.
    The list goes on and on.

    I have called the police on them on almost all occasions, but nothing seems to stick on either of them. (possibly because my childs father, his father is a retired police officer)

    Most recently they have been calling and appearing personally at my childs school to obtain a copy of her records.
    They also have been asking for a copy of her doctors records, a copy of her SS card and birth certificate.

    My family court lawyer insists that it is within my childs fathers rights to have this information. Does this have any truth to it?

    I am concerned for my childs well being when she is with them, mostly her MENTAL health, but pyschically as well.

    I do believe they are trying to take my daughter away from me. I think they are trying to build a case against me somehow, and are going to summons me into court again.

    I am tired of going to family and criminal court repeatedly, being harassed, investigated, attacked, and all in front of my daughter!

    Can I have my daughters fathers rights or visitation removed?
    My daughter has told me that she is scared of him, and cries because she doesnt want to go with them? is that grounds to have his visitation revoked?

    Please help me im desperate. Thank you

    Dad is absolutely entitled to that information.

    You could well be penalized yourself if you try to prevent him from obtaining that information.

    You need to be encouraging your daughter to go with Dad - if she needs counseling, that's often a very good thing to help her cope with situations where she's unhappy. You can also be teaching her good coping skills. If you're worried that Dad is going to go for custody, don't give him ANY ammunition to help him.

    Nothing you've said here would be grounds to stop visitation and certainly nothing comes close to what is needed to terminate his rights.
