    Default How to Amend an Eviction Complaint

    My question involves an eviction in the state of: FL

    I filed Pro Se for an eviction and included a Count II for back rents. I got the instructions and forms from the clerk's office but I had to create my own form for the Count II. The instructions say that once after you get possession, you can Amend the Count II if you find damages, but it does not tell you anywhere how to do it. I searched the internet but couldn't find anything. The clerk told me she had done it before but she wasn't allowed to help me.

    Can anyone tell me how to amend a Count II eviction that's already filed. The Count I is already in default and I'm waiting for it to get signed by the judge, the Count II 20 days are up on August 1, 2011.

    Review the court rules for the court in which you're litigating. For example, Rule 1.190 of the Civil Rules, available here.
