Injury Case, Did Defense Lawyer Blow the Statute of Limitations Defense

My question involves an injury that occurred in the state of: california

i started the case myself but i guess i need a lawyer now.

i filed it late, but then the defense lawyer was too late filing their 'demurrer' about the statute of limitations!

did they lose that defense? or can they just bring it up again when they answer?

hopefully we can do business.
