My husband is thinking of possibly sueing our neighbors in civil court. In June my husband was arrested on felony charges of animal cruelty because our neighbors dogs were running through our neighborhood. These three dogs attacked my husband and he shot two of them from ten feet away. Anyhow, after using a bail bondsman, we paid $1500 to get him out of jail. We expect that the charges will be dropped since witnesses also saw the dogs charge to attack my husband before he shot them. The dogs were running around without collars. We also did not know our new neighbors had dogs and have a problem with dangerouse strays in our neighborhood since we live on the edge of the desert. Since this incident, their remaining dog gets out about once a week and tours the neighborhood. We call animal control every time and make sure to get take a dated photo of the dog or get it on videotape.
Anyhow, my husband wants to sue the neighbors for the $1500 and any other legal fees once everything is handled with his felony charge. I think we should just cut our losses. I realize this is only a brief explanation, but does anyone have any advice on the sitatution? Thanks
Oh, I will say one of the dogs shot was a pitbull-the dogs were packing, thus the reason my husband got his gun. The dogs had come into our garage before they were shot, but were shot off our property in the street. The remaining dog is also a pitbull mix. Thanks again.
