    Default Charging Higher Premiums Because Spouse Does Not Use Insurance Offered at Work

    My question involves insurance law for the state of: Indiana

    My husband's insurance carrier (Cigna) recently sent out notices that they would like to know the working status of spouses. The letter stated that employees who have a working spouse who opt not to use the insurance offered through their employer (if available) must begin to pay a $50 per pay charge. Is this legal?

    The "other" insurance available to us is a high deductible, high premium plan. It is not beneficial for us to have 2 seperate carriers for insurance nor do we feel it is fair that we have to pay more because we choose to use one carrier over another. Not to mention, they want to know the status by August 31st and we have a baby due at the end of September.

    It is not only legal, it is becoming quite common.
