    Default Uniform Child Abduction Prevention Act

    My question involves a child custody case from the State of: Ca.

    I had my First child custody hearing this week and in my petition i asked for orders regarding not allowing my child to be taken out of the state without my consent during the hearing the judge just gave us dates for mediation and for our next court date im wondering should he have at least granted that during the hearing as i am worried my stbx might take my daughter without my permission to another state.

    See that's the problem i was in the understanding because this was an osc custody hearing that we were supposed to get temporary custody orders in place during this hearing and nothing was ordered we were just ordered to go to mediation and that isnt set untill sept 1st and then the next actual hearing isn't until oct. Am i supposed to have temporary orders in place first? I know i should have a lawyer but unfortunately I am on a very limited income and my budget does not allow for an Attorney.

    There's no requirement, but temp orders do help.

    The judge was under no obligation to order a restriction like that, though it's not uncommon.

    There is already a standard restraining order in effect.

    However, the judge can't make any orders until you go to mediation first. You put the cart before the horse. You should have scheduled mediation when you filed the petition.
    If you wanted babies all to yourself, you should have created them by yourself. Until you do that, children have the right to BOTH parents, especially since you found them suitable to procreate with.
