    Default Permanant Restraining Order: Lifetime Ban

    My question involves child abuse or neglect in the State of: Massachusetts

    My niece is pregnant by a knucklehead. Turns out the knucklehead has a 9 yr old daughter (who lives with mother's parents). The court issued an RO, but converted to a LIFETIME PERMANENT NO CONTACT ORDER.

    The records are sealed.

    My question: How easily are these attained? Would SIGNIFICANT ABUSE had to of occurred? Drug addicts and child abusers get supervised visitation...but a LIFETIME NO CONTACT? Is he a pedophile?

    Is the NCO actually for the child? Or the mother? Permanent orders can be obtained by default (if he didn't turn up in court), or for several reasons.

    I understand your concern - but your niece made a choice. Now she'll be dealing with him for a long, long time.

    He has a lifetime NCO from him seeing his daughter, who DOES not live with the mother of the child.
    Thoughts?

    My thoughts are - honestly - to let your niece deal with this man.

    Since he obviously hasn't abused your niece's unborn child, he'd likely be able to get at least supervised visitation. But really - even child molesters can have supervised visitation with their children in some instances.

    Your niece picked him - she's telling the court that he's fine parent material.

    appreciate the advice, however that wasn't answering my questions:

    Seriously, how would anyone here know if he was a pedophile or not?

    Only someone who has local experience in that jurisdiction would be able to tell you with any accuracy how often the local courts hand these out.

    I'll give you an example. Over here in WA, two particular counties handle things very differently. My county will generally require something involving the child directly.

    However - a couple of counties over, a parent can obtain a permanent NCO if there is repeated domestic violence against that parent with the child present. Nothing necessarily has to physically involve the child. In my county? Not likely to happen.
