    Unhappy Malicious Destruction of Property Charges Involving a Vehicle

    My question involves criminal law for the state of: Michigan

    I Am being charged with malicious destruction of property of my ex's vehicle... to which he doesn't own anymore and I'm pretty sure he never fixed what was wrong with it..


    We were driving back from a mud bog an had an argument, I had been drinking but wasn't drunk, i had called him a name and he stopped the truck 30 min from the city i lived in an physically pushed me out with a lot of force. I had got a ride back to my car from a gentlemen who was following us.
    When we made it back i called my dad to come help me put my hood back on my car (took it off to paint it). I went inside right after i hung up to use the restroom, when i came out his dad and him were putting my hood back on an i asked them to leave it alone my dad is coming. ( i was very upset at the time an used some choice words) My ex stopped what he was doing and went to his truck, grabbed my sunglasses came back to the barn an threw them at me, I threw an object back an started to run towards him, shortly after i thought this isn't a great idea i stopped about a foot an a half in front of him. My ex then grabbed me and slammed me down on the ground with one hand on my head an the other on my shoulder (i was pretty twisted up) the only defense i had was to pinch his stomach (which i did pretty hard and twisted) he then would put pressure on my head an shoulder the harder i twisted and wouldn't stop till i let go (i wasn't letting go until he got off of me) soon after his dad yelled at him to get off of me and then my parents pulled up the driveway... finally he let go. My first reaction was run straight to a rock and throw it at is pretty truck (an i did)
    I really didn't do much damage as i though i was going to. It left a quarter size dent that could be pulled out an a scratch that could be buffed out. My ex then called the cops. When the cops arrived they talked to him and his dad first so when the talked to me they asked if i was drinking i said yes... then it was like talking to a wall and dint care to hear anything i was saying the officer told me i couldn't press charges of assault on him because i threw a rock at his truck. Two weeks later i was contacted by the prosecuting attorney that asked me a few questions an that was it, I never got a paper in the mail stating that charges was being put against me, i had talked to my ex asking if we could settle this outside or court and i just give him the money for the damages so it could be fixed he said it was going to cost me
    1170.39..(yeah right)((he knew i had the amount on me and said if i pay it to him now he wont press charges)) that was because he wanted and had been talking about before this all happened a new paint job for the truck... a month or 2 later he sold the truck and has had 2 trucks since i dated him his brother said he never got the truck fixed from the small damage i had done to it... what are my options in this case should i get an attorney??

    If you're charged with a crime, then it makes sense to consult a criminal defense lawyer.

    If you have not been charged with a crime, you can decide for yourself whether you want to consult a lawyer about whatever it is that's presently concerning you.

    Your narrative is not clear. If you are stating that you agreed to pay $1,170.39 in return for having the charges dropped, and now hope to back out of that deal, you take your chances.

    Im sorry, he wanted to make an agreement for me to pay that amount and he wouldn't press charges... i know from asking plenty of people that work in auto body that it wouldn't have cost as much as he was quoting me.. therefor i didn't agree with him. I am being charged with this crime as a misdemeanor, just would like to go kinda knowing how things might turn out.
