    Default Eviction on Home I am "Purchasing"

    I am late on my house payment and my lot rent for the mobile home I am purchasing. We are in a mobile home park. I was served yesterday with court papers for eviction. I am purchasing this home. I have a title in my name with the bank as the lien holder.

    What should I do now? Can they evict me? or do they have to foreclose?

    I was not served with a 3 day pay or vacate notice, just the eviction order to appear in court on Tuesday?

    I live in Dallas County Texas.

    If you're late on your lot rent, they can evict you.

    I agree with aaron! We bought a mobile home when we were very young, and we were late with the space rent, and they could evict. This is why I always recommend to buy a house on its own property, so the only one that can get you evicted, is you for non payment for the loan. Sorry this happened to you. Have you looked in your rental agreement to see if there is a grace period? Did you go over that grace period?

    Thanks for the reply...If we paid the past due on the lot rent, can we stop the eviction? She said that she requires us to pay the full amount of the past due, which includes the house note, utilities, lot rent and late charges.

    I can pay the past due charges for the lot rent and utilities before the court date. My ex had stopped making his child support payments which is what put me behind.

    Is there anyway to stop the eviction? or Win in court?

    This is hard to say without the rental agreement in front of us to read over. If there is no grace period, and an eviction is final, there may be nothing you can do about it. I am not an attorney, so this is only my opinion. Since you would have to pay for these eventually because you owe them, it couldn't hurt to do so now and show the judge that you "paid up".
