    Default Legal Realism

    Am I right to assume that the choice of word usage (in bold but mainly-mitigate) that the judge is a legal realist? And if so, what word usage in lieu of 'mitigate' would a legal positivist use? I thank you.
    In a case like this the principle of executive clemency seems admirably suited to mitigate the rigors of the law

    First and foremost, I thank you for your educated responses. Indeed , it is a homework assignment. One must choose, in the case study, if one belief is: legal posivitism, legal realism or natural law.
    Truly he is a legal realist but am I correct to base that on his word usage (those words in bold) as it would be apparent if one said one was 'pro-choice' or 'pro-life'? Thank you for your invaluable input.

    Rather a cheeky b*st*rd than a lazy do nothing that feels homework doesn't provide any value other than the answering of questions.

    Have you figured out yet, Scooby, that half the purpose of homework is for YOU to figure out where to find the answers?

    Oh... and it is also the purpose of an attorney not to represent themselves, their clients or the purposes of either fraudulently.... as you did.
