My question involves independent contractors in the state of: Washington
I will be working 6hrs a week for a local business doing Intuitive Readings. At the meeting with one of the business owners she stated that I would be considered a "IC" Now I've looked on the IRS website and I'm on the fence as to whether or not I can be determined a IC or what's called a common law employer. Under Common Law definition I meet the behavioral and financial part of that definition. Company controls what I will do i.e. day worked hours worked they also control how I will get paid. The only thing I supply or provide for the job is my tarot deck and business cards (which I get for free from a friend) so no business expense for me at all. Should I file a SS-8? and If I file this will the employer get mad over this? I know if the IRS determines I am common law and not IC the employer will have to pay the tax is that not correct?
