My ex and I divorced six years ago with one very sloppy lawyer. We agreed for him to take the property and buy me out, but this was not made part of the agreement. I was ignorant enough not to understand the difference between the financial liability of a mortgage and property ownership, and didn't know a quit claim didn't affect my financial responsibility.
My ex and I are now friends and came to a mutual agreement for him to buy me out voluntarily. We were scheduling an appraisal to refinance when there was a minor accident on our property involving something he owns and I do not own and a stranger. (I am not going to go into the details). We are afraid that the woman who had minor injuries will try to get rich off of us, and our home owner's insurance does not cover the incident.
We are divorced. Am I responsible for what happened on the property with his property? If I am not responsible, can he quit claim the property to me now to protect the house from a civil suit if he were sued?
