    Cool Injured in a T-Bone Accident After Getting Cut Off

    My question involves an injury that occurred in the state of: IDAHO

    While traveling down a main road a negligent driver pulled out in front of me from a convienient store while i was going about 35 MPH. didnt see her or have enough time to stop so i tboned her vehicle totalling both cars, she was cited for failure to yeild and i suffered disc bulging that starts in my thorasic spine and goes down to the lumbar spine. i also have an annular tear in one of my discs. 13 weeks of therapy and 2 steroid injections later, im still in pain, 20k in medical bills, 7k lost wages and a lot of suffering along the way, it's been 18 months since my accident and the insurance adjuster has only given one offer which was unreasonably low at only 16k. we declined their offer and my lawyer says they have until july 5th to respond before going to lawsuit, what does this mean and how much longer do i have to deal with this crap?!

    It is reasonable to infer that your lawyer intends to file a lawsuit if he does not get an acceptable offer by July 5. You have to "deal with this crap" until you either accept an offer of settlement or until the case is tried to a verdict (with the possibility of subsequent appeals).

    What exactly would you consider to be an "acceptable" offer given the amount of information provided in the above post? Since this was written, I have had 2 additional injections, and am scheduled for a discogram on Monday. Do cases settle while treatment in ongoing, or do poeple usually wait until maximum medical improvement? Why or why not? What is the general timeline on compensation for these types of injuries? What happens after a suit is filed? How can I prepare for trial if indeed that is where the case goes? Do you have any general advice for people in this situation?

    We're not in a position to assess your damages. If you want a meaningful assessment, you need to talk to a lawyer who has reviewed the full facts, the medical records, treatment history, and knows the prognosis. With serious injuries the limits of the defendant's insurance coverage will often define the amount that can be recovered, even if the injuries would justify a greater settlement or award if the defendant had the means to pay it.
