    Default Someone Used My Name (Fraud) on a Speeding Ticket and I Can't Appeal

    My question involves a speeding ticket from the State of: Washington

    Okay I am really aggravated because I never had a driver's license in my life and don't even drive or own a car. Here is where my story begins...

    Several months ago someone used my name and I didn't get a notice untill 3 months later that I had a $1,347 speeding ticket fine. I was really pissed off because I planned on getting my driver's license this year and this will affect me from getting one untill I pay off the fine and I wasn't going to pay off for something I didn't commit so I appealed.

    After the first appeal letter I sent in they kept sending me letter (about 3-4 more times) telling me to appeal to this place, appeal to this address, write your appeal to this place, ect before the date given. It was bothersome but I did it anyways and wrote a letter of appeal each time before the due date. The last letter they sent me was for an administrative review which costed me $40 for the court to review I payed it off and a few days letter they sent me a letter telling me to go to the King County Superior Court and file some paperworks. I went in and the clerk was telling me something different she told me the administrative review is for appealing the money in collection. I was like WTF? I am appealing a speeding ticket that was wrongly issued to me. She told me the Department of Licensing of Renton had to file it in for me about the speeding ticket I was appealing. I am pissed off because I sent in the appeal letters to their address before the dates they told me to. Now I have a hunch that they never filed it for me and its been 2 months

    I am beginning to lose faith in this justice system. All I want is for them to grant me a hearing, bring in the officer, pull out the driving records with the car license plate and bring in whoever owns the car. From there justice will be served. What should I do> My money is in collection, I wont be able to get a driver's license untill the fine is payed off? Is there anyone that can help me?

    So how exactly does this happen when ID must be shown at some time? If the person didn't have a license, how were they able to drive away from the scene? How were they not arrested? How was the vehicle that the person was driving NOT impounded? You need to go talk to the prosecutor to see what the exact details of the case were. Since your name was illegally used, I am sure they will sit down with you and see what is going on. Someone jerked THEM around as well as you. The person is guilty of identity theft if what you say is true. Any ideas who it was? Certainly someone who knows your name and thinks you're a sucker. Apparently they know you well enough to give up your name and at least address, possibly Social Security Number.

    You have 30 days to send the debt collection agency a letter demanding PROOF that YOU owe THEM money. I would do this immediately.

    FDCPA Section 809. Validation of debts [15 USC 1692g]


    (b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

    Thanks but its already in collection I went to the court on the 26th of Arpril and I had to do it before the end of the month and no one has responded. How will I contact a prosecutor if there is no court date??? I am screwed. FML.

    You go down to the prosecutor's office and talk with them. Call them up. Write them. Running around with your tail on fire when you did nothing wrong is not the right approach. You need to assert that someone used your name, and that the person they pulled over was not you. Make them PROVE that it was you. They can't, because it wasn't you. If the officer didn't document a driver that gave a name, then he did not do his job. If they cannot prove it was you, then they have no case against YOU.

    What type of Prosecutor do I need to go to? What if its too late for a court because the dumb people who I sent it to never filed it for me?

    Oh and why go to a prosecutor office when there is no court date issued or setup? They are just going to brush me off don't you think?

    The prosecutor is the prosecutor. They filed the charges with the court. If there is a collection notice, then there has been a case through a court, and SOMEONE was found guilty, probably for a no-show. Go talk to them about it. You can look up your name and get the case number via http://dw.courts.wa.gov then you will at least know if your name was REALLY used, and what court it is out of, then you can go talk with the prosecutor. It is possible that a collection agency completely screwed up and it isn't ACTUALLY you they are looking for. Do you have a common name? If so, it's possible that this isn't some big conspiracy... rather a clerical error. Just curious... what is your age?
