    Default Why There Can Be A Delay Before You Hear From The Court

    I've read a lot of posts where people are wondering what is taking the court so long to send a notice to you. A common scenario is that in order for the prosecutor to proceed with the filing, a complaint must be signed by the LPO from the store you got caught it. A lot of LPO's don't always work at the same store, they move around the district a lot. This can cause a delay. Its also a job position that has a frequent turnover rate. Sometimes you can get lucky and the LPO is no longer working for that store. If they can't track he or she down to sign the complaint, you most likely won't get charged unless they have you on tape.

    who sends out the civil demand letter ? Does it come from the LP office? thanks

    Civil demand depends. Are you talking about the store fine or court order restitution for damaging merchandise/etc?

    An order for restitution following criminal proceedings would not be civil in nature; it would be part of the disposition of the criminal charge.

    The store, the store's loss prevention department, the store's legal department, the store's contractor who handles their civil demands.... it's going to depend upon store policy.
