    Default F2 Dependent Status After Divorce

    Am a F2 dependent visa holder entered USA after Marriage.My marriage lasted for 5 months. i was physically abused( domestic violence) ,Dowry issues- my husband expected money from my parents to take care of me and to spend for me saying he was on F1 status, when questioned about it he would harass me ,and physically abuse me. since i was new to USA after wedding i did not know that i had to report to the cops about it. i could not tolerate anymore, so left to my home country.
    i have complained to the cops in my home country and planning to apply for divorce.
    since am on F2 dependent status what will happen to this visa? is there any divorce benefits with my visa? how can i enter US again?
    can somebody help me on this.

    Your F2 is based totally on you being your spouse's dependent. When you divorce, you will lose that. If you are in the US at that time, you will have to leave. You may enter or remain in the US only if you are able to obtain status on your own.

    What divorce benefits in the US would you expect as the dependent of a student visa holder? It is really foolish to marry simply for a US immigration benefit which is what you appear to have done.

    Thanks for the reply and for letting me know about my visa status. since am a Doctor i was getting trained to obtain my licence in the USA during my stay there. now my profession is at stake due to matrimony issues. i can get a visitor visa to go to USA but that again will be for a 6 months period and again i will have to exit. My husband is responsible for all this now, since am the victim who had to face domestic violence and physical abuse and there was no other go than to come out of it to save my self. if i got married simply for a US immigration benefit then i would have not exited the country first of all and will not apply for divorce too.
    society seems to be blind and supports people who are unfair!!!

    one more thing to highlight, if i had to marry simply for a US immigration benefit as you have mentioned in your reply. Then i would have got married to a green card holder not to an F1 Student Visa holder!!!!!

    This is unusual under the terms of an F2 visa.

    No one is ever guaranteed entry into the US or the chance at permanent residency. You appear to have an unrealistic expectation of US immigration benefits. Your marriage granted you entrance in order to "study" in hopes of a future benefit. If your medical training was at a reputable institution, there are other ways in which to enter the US to pursue your career.

    Marriage to a green card holder has a far longer wait for admission to the US than as a dependent of a student. As such, marriage to a student visa holder would result in a faster route to the "studying" you claim to be doing.
