    Default Deported with Schizophrenia, How to Come Back

    i was deported from the US in 2004, schizophrenic ..one day i got caught shoplifting they took me to police station i spent the afternoon they sent me to detention center (where there's only people to b deported not a jail).

    after 3 months,witout going to court they sent me on a plane to my country. please let me know what can i do
    to go back to chicago IL ,whe have my brother he is in the US and can pay for an attorney.
    this just a regular deportation like other people in this forum but i don't know how to fix this problem and come back please help me!
    i can go there and marry a girl i know (US citizen) i can wait for 2014...just let me kno.w..

    You were deported under what provision of the INA? Was it INA Sec. 212(a)(1)(A)(iii)(I) or (II)?

    InMy paper it says:
    it is charged that you are subject to removal from the unite states pursuant to the following provision(s) of the law: section 237(a)(1)(C)(i) of the immigration and nationality act (ACT) , as amended in that after admission as a nonimmigrant under section 101 (a)(15) of the act.

    That clause of INA Sec. 237 provides, "Nonimmigrant status violators. - Any alien who was admitted as a nonimmigrant and who has failed to maintain the nonimmigrant status in which the alien was admitted or to which it was changed under section 248 , or to comply with the conditions of any such status, is deportable". That provision relates to your apparent desire to immigrate, not to mental illness. Is that the only provision mentioned?

    yes the only provision.
    they didn't know about mental illness...
    please let me know again is an attorney all i need to comeback in 2014?
    do i need to get maried?
    will it be easy or hard to get visa and come back??

    If your deportation has nothing to do with mental illness but resulted from overstay, you can try to get a visa once your period of ineligibility expires; we have no information with which to judge if you might qualify for a waiver. Your mental illness may be an issue at that time, depending upon the full facts and your condition at that time.
