    Post Trees on Property Line

    My question involves real estate located in the State of: Maryland

    I have many large trees along my property line. Several years ago a couple bought the lot behind me and built a house. The trees have always been there. Now years later they are insisting for safety reason that I cut them down. Recently I had a tree service on my property to inspect these trees and they said the trees are all alive and healthy. It would cost me a fortune to cut these large trees down. What are my obligations?

    if they are on your property and they are healthy, you have no obligation to do anything with them. Keep the statement concerning the trees on file so you don't lose it. It could be helpful in the future.

    If they are on your property, how do they present a safety hazard to the neighbors?

    Another point to consider is the nature of these trees as boundary elements. If any of the trees are called for in your or your neighbor's deed, then they are legal monuments, something we surveyors strive to preserve.

    Even if they are not called for in the record, they might still be used as evidence of the line. In the event that your corner pins are obliterated, those trees may be the best evidence to place the line on the ground.

    Thank you for the reply. I'm not overly worried about it, but I guess the only "safety" issue is if one of the trees falls and hits their house.
