    Default Liability for Rent After Breaking a Lease

    My question involves landlord-tenant law in the State of: Pennsylvania

    Hello!

    After reading over my lease again, I noticed there is a clause about breaking the lease which states I would be liable for unpaid rent if any terms of the lease is breached. Because of this, the question I posted yesterday is irrelevant. Now, I'm wondering if I break my lease and a new tenant moves in, will I still be liable for the unpaid rent even though the apartment has been rented again?

    You would be responsible for any penalties spelled out in the lease. The LL can seek rent for any time period that the apt is vacant. So if you break your lease on 6/1 and LL doesn't get someone into the unit until 7/1, you would be liable for 1 month. I believe the LL is required to be actively seeking to fill the unit in order to claim you owe the rent for the vacant period. This varies by jurisdiction so you would need to research for your particular area.
