    Exclamation Punishment Due to Opinion

    My question involves employment and labor law for the state of: Colorado
    I am a hostess at a restaurant. My manager refuses to give me hours or "promote" me to a higher position based on her opinion of my attitude toward the guests. She has decided that I come off as though I don't enjoy my job and insists that the guests can see this. There have never been any complaints, I have never been written up for anything, and until I approached her about the situation nobody ever said I was doing anything wrong. At my job we receive monthly shopper reports to see how well we are doing our jobs. I received 100% on my report. the following month there were a couple reports that came back and were lower scores, and she tried to "pin" them on me. She never took the time to look and see whose reports they were. Is there anything I can do?

    Yes, there is something you can do.

    You can figure out why it is that your boss thinks you do not enjoy your job and fix it.

    Your employer does not owe you additional hours or a promotion. Your employer is not doing anything illegal. There is nothing you can do in the way of legal action that will force your manager to promote you or give you more hours. There is no law you can invoke that will force your employer to promote you or give you more hours. You are entitled to exactly as many hours as your employer wants to give you; no more, no less. You are not entitled to a promotion unless your employer wants to give you one.

    Just to make sure there is no possible question, it is 100% legal for your manager to refuse to promote you or give you more hours based on her opinion of your attitude and how much she thinks you like your job. That was the answer the last time you asked it; it is the answer now; and it will be the answer the next time you ask it.
