I purchased my property over 20 years ago with a 500ft x 50 ft right of way that ran along his property line to my property. At the time of purchase, the seller verbally told me I could remove trees in the right of way as necessary to my property. The actual road is only about 15ft wide. He has since move away, however he also sold a lot behind his own that borders on my piece, and the right of way runs through this lot as well.
Over time trees and brush within the ROW along the road had grown over the road and I decided to remove these to eliminate them brushing vehicles passing through. The current owner came at me with considerable hostility and informed me that I had to get his permission to cut his trees in the ROW and also to make any improvements, such as widening. My question is, do I have any legal obligation to get permission from a landowner to cut trees or make improvements to ROW on his property?
