    Default Retaliatory Conduct Towards Student Who Filed Complaint

    My question involves education law in the State of: FLORIDA


    I am enrolled in a college (accredited, FAFSA etc) for over a year. I am an excellent student in all aspects. Last month I filed a detailed complaint regarding teacher misconduct and teacher abuse towards me. by the way all the students complain between themselves about this teacher. I informed them in the complaint that any meetings regarding the matter, I will come along with my interpreter since English is not my native language. This college is emailing me threats that they will drop me out of the program unless I agree to meet with the director "alone" without my interpreter whom they have "no legal obligation to meet with since he is not a student". Today they handed me a letter they said I must sign. The letter is laughable, It states that I (the student) disrespected the teacher/supervisor and also did not adhere to rules etc. I took a copy home and did not sign it. I told them I need to run it by my interpreter.

    Do they have the right to drop me out with the only reason being "not signing their letter" or "not agreeing to meet with them alone" ?

    We have no access to your school's disciplinary rules and procedures. We don't know why your school objects to your having an interpreter present for the meeting; perhaps their position is that your English is fine (as evidenced by your enrollment in an English-speaking university, attending classes in English with no interpreter, and taking tests in English?) We don't know the facts or the allegations against you and have no access to the letter you've been asked to sign. Run the details past a local lawyer, preferably one who has handled university disciplinary matters for other students.

    You don't explain what the teacher's misbehavior is... but if it doesn't rise to discrimination, you really don't have a case.

    Here is the thing. Let's say that a teacher is rude to you. According to you, that teacher is rude to EVERYONE because EVERYONE talks about it. Therefore, the behavior is rude but not discriminatory.

    You filed a complaint. There is nothing illegal about being rude... and there are those that may think that grown men and women should have a little more ability to be treated like adults and not coddled as children.

    Anyway, the university didn't find anything wrong. Therefore, the TEACHER now has a grievance against you for the complaint.

    You want to bring an interpreter. The university is under no obligation to allow this.

    I don't think the letter is laughable. To me, it sounds about right. I don't know what you did but you apparently you went over the line.

    Sign it or don't. Realize that it may be your way of saying you don't want to go to that university anymore.

    If you read carefully what I wrote you will notice that the discrimination is coming from the school (not the teacher who I complained about). The school began to retaliate against me right after (and perhaps because) I complained about a teacher. The school did not take on this behavior towards any other student, perhaps because other students did not file any complaints.
