I really appreciate you getting back to me so quickly, the only other question i have is related to my original post. Does the officer have the authority to mark the "not correctable" box next to a correctable violation i looked through the codes you suggested but there is nothing there about his authority to say whether something is fixable or not ......
Re-read VC 40610, specifically subsections (b) and (c). I don't know what transpired during the stop, what the officer told you, what you told him, or whether you have any prior window tint citations or mechanical violations... But the officer DOES have discretion to cite it as non-correctable. In fact, most CHP officers will always write it as non-correctable, its nothing new!
Of course you can make the correction, schedule a court appearance, take proof of the same to court show it to the judge who also has discretion to accept the correction, but I offer no guarantees that it will work out in your favor.

i know this seems like a lot of hassle just to go through to fight a tint ticket but it comes down to money they hit me with a $250 fine just for tint because he marked that box i just don't understand if it is a correctable violation how can the officer do that. any help would be greatly appreciated.
I don't know where you got the $250 from... the highest I've seen it is around $190. So what code section were you cited for? And was that the only violation on your citation?
I am right 97% of the time... Who cares about the other 4%!
