    Question Car Accident Involving a Jay Walking Pedestrian

    Hi,

    I currently live in Houston, TX. I was wondering what happens, if a pedestrian was Jay Walking in a middle of a road and than was struck by a car. She was injured and taken to the hospital by an ambuluence. But the person driving did not recieve a ticket by the cops, after a lengthy investigation. The cop also reassured the driver that he was not speeding at that time. There was a neutral witness that viewed the accident and his statment was pro driver..and said how the lady was not crossing the street carefully and not looking for traffic. The insurance knows about the incident. What should the person do know? Should he hire a lawyer right away, or wait for the cops to call back and should he have anything ready? Any other advice, maybe something he should be taking extra precaution in? Please let me know. Thank you.

    He should notify his insurance company and obtain a police report.

    Yeah he has already notified the insurance and will obtain a police report since it takes two to three days to get it al right. But after that should he just sit on it? Or take any legal action that might beneift him?

    Hi, rmet.

    OP: There is nothing more to do. There is no reason to contact a lawyer at this point, especially since, based on your post, you were determined to be not at fault, and because your insurance company will defend you, up to the limits of your policy.

    HI! welcome, there are many of our friends here, Carl, Lwpat, CBG, Shay, Happy, Weenor, Ohiogal, Silverplum, Ellencee, Melane? and others who's names escape me at the moment. IAAL is alive and well here and some members thought we were the same person but, Carl, Shay and Happy all indicated otherwise, lol!
