    Default Appearance Date Approaching and No Reply from Trial by Written Declaration

    My question involves traffic court in the State of: California

    I got a ticket on 1/21/11 for Failure to Yield 21950(a).
    Initial due date was set to 3/23/2011.
    Submitted extention request and got extended to 5/23/2011.
    Paid my bail and submitted my request for the TBD form on 3/16/2011.
    Check cleared on 3/22/2011.
    Got my TBD form from the court on 4/16/2011.
    Filled it out and mailed it on the very same day. (This is where I made the huge mistake. I was too excited to send the letter back to the court that I completely forgot about sending it with certified mail.)

    Today is 5/17/2011 and my new appearance date is set to 5/23/2011. I've been checking the mail everyday hoping I will get an answer from the court before the 23rd comes but after reading a few posts on this forum, looks like I won't get an answer for maybe at least another month or so. I checked on lasuperiorcourt.org and the site says the following:

    Violation Date: 01/21/2011
    Initial Due Date: 03/23/2011
    Case Status: Extension
    Disposition: 03/21/2011
    Last Action: Extension
    Last Action/
    New Appearance Date: 05/23/2011

    My question is... should I go pay a visit to the court on the 23rd to see what is going on or should I just keep waiting for a reply from the court? I have proof that the bail has been submitted and that the check is cleared from my bank account, but I do not have proof that I sent back the TBD form since I didn't send it as a certified mail. Any advice? Thanks in advance.

    Sounds to me like the 5/23 date was the due date to submit your declaration and bail payment. It would also be the due date for the officer to file his declaration. If you want to ensure that the declaration was received then you'll have to contact the court clerk. He/she can also give you an estimate as to when the decision will be made.
    I am right 97% of the time... Who cares about the other 4%!
