    Default Terminated Due to False Accusations

    My question involves labor and employment law for the state of: MO

    I was recently fired due to the accusation that I caused a loss at my place of employment (Urban Outfitters). I have never stolen a dime in my life and due to this quarters numbers there was an overwhelming amount stolen. I had just got hired on before the holidays as the new display artist and was given an employee discount card. Therefore I had made a couple purchases for my wife which later had to be returned without a receipt because i threw it away. Although, when she returned it she mentioned to the cashier that she was returning as a gift from her husband who worked here. On top of that i had received a gift from my mom from there that didnt fit and i didnt have a receipt so my wife also returned those as well.

    Well...all of a sudden without warning whatsoever i get called into the office as the big boss over loss prevention starts accusing me of returning items at full price when they were bought with a discount and then receiving a store credit card and using that to purchase more items with my discount (double discount). They also accused my wife of changing her last name when making the returns which is completely bogus. My wife specifically stated that these were employee returns which means it should have been the cashiers duty to do the math. Instead they refunded us the full amount. Also while the big boss was accusing me he brought my religion into it using that against me saying "you call yourself a christian but yet you go and pull a stunt like this." And he continued to say that me and wife had a scheme going this whole time.

    What makes me mad more than anything is that i worked my butt off and never caused any problems and one day out of the blue i get yelled at for something that was not even fully my fault. Yea. I probably should have been more aware of how much was being put on my card but i feel like I was totally canned for something that should have been discussed or been a warning or at least brought to my attention because I had no idea.

    We have recently gotten ahold of one of the uppers in loss prevention to see if they could get us the transactions (proof) that they are accusing me of and they said that they couldnt. So my question is, what kind of action can i take against them? Can i file for false accusations & discrimination? Or do i have a lawyer write a letter to obtain the transactions? Or do I contact the labor board and start a case?

    There is no requirement whatsoever that you have the situation discussed with you beforehand, or that you be given a warning, or that the problem be brought to your attention. While not the way I would have handled it, it is quite legal for you to be fired out of hand for a suspicion of theft even if you are innocent and even if you can prove it. This is not illegal discrimination. I am not seeing any legal actions you can take at this time.
