    Default Martial Arts Membership - Classes Were Cancelled

    My question involves a consumer law issue in the State of: Illinois

    Several months ago I signed a one-year contract for a martial arts gym. I work from 5 pm to midnight, 6 days per week, so I chose the gym which had morning classes - specifically a Jiu Jujitsu class. A few weeks into the membership they canceled the morning Jiu Jujitsu class. This was very disappointing, but I could still take the mixed martial arts class 3 mornings per week. Now as of this week I get a notice that they are canceling 2 of the 3 morning classes.

    I was very happy with the gym when I first signed up, and with the schedule that they provided me when I signed the contract. Before, I was able to go to 4 classes per week. They have canceled 3 of those, while I am still paying the same price. I realize that I am welcome to the night classes, but I specifically chose this gym and signed the contract because of those morning classes.

    I am pre-paid for 2 more months, then will be going month-to-month for the following 5 months. However, I was wondering if them changing the schedule is enough reason to be able to cancel the contract?

    IMO, you do have enough cause to cancel the contract. I suggest reviewing the contracting to see what grounds it contains for canceling. Approach the management and explain that due to the gym substantially changing the conditions of the facility you are no longer interested in continuing your membership.

    Will it work? Probably not. The gym will probably say "tough". If you only have two months left on the the pre-paid portion unless the rates are outrageously high it will cost more to go through any legal proceedings than it is worth.

    antrc170, in your opinion based upon what? Your review of the contract? Your knowledge of Illinois statutory or case law? Please elaborate. Every gym I have ever attended has, over time, changed the classes it offers and when the classes are offered based upon need, interest, and the availability of instructors.

    Chris, would it be correct to infer that the issue here was the lack of interest by others in daytime classes? What, if anything, did the gym do or say that suggested that it would not significantly change its class schedule for the duration of your contract?
