    Default Right of Way Abuse

    My question involves an easement in the state of: Tennessee
    As landowner ROW was granted to River access through our property. Excessive use of firearms, firepits and rubbish is beginning after 5 yrs of "nice" atmosphere. We will be looking for bullet marks on the trees, any occurence will hinder us from harvest and will allow us to sue.
    How do I prevent the use of firearms without express permission. How can I stop them from building fires (they never put them out.) And the rubbish.......bullet shells, wrappers, etc. What are my rights as the property owner and taxpayer. They have land next to ours, yet abuse our land. Help please. Thank you in advance.

    I would first ask who ever manages your neighbor's property to clean up their act. Their easement though give them the right to pass across your property and I suspect if you tried to somehow restrict their access due to their being crappy neighbors, you'd end up in court. Of course, vehicles breakdown, sometimes frequently, and it always takes time to get them running again and out of the way. If you had a reason to get from here to there on your property along their easement, and your vehicle breaks down frequently due to its mechanical condition, I don't know what the court would do, particularly if their other neighbors were on your side.
