    Exclamation Busted for Shoplifting at Walmart

    My question involves criminal law for the state of: Texas
    Well, I got busted last month for a shoplifting under $50. It was about $5 over when they actually press charges. So here I'am waiting for court on thursday. I had a previous theft charge when i was a juvenile. I got off of probation in another county in November. I've had my share of run-ins with the laws. Including a minor in possession. Nothing more serious than the POM i got for my probation. That all being said, I'am curious of what my outcome might be. I'm hoping to get some diversion or something, but i dont know what way to go about getting it. I've read a few forums and was still unsure so i posted my own. I'am not trying to hire a lawyer, because i dont have the money. It will be a big enough pain in the ass paying the fees.

    Diversion programs are for First Time offenders. Not people that the court knows by name. No lawyer or PD can get you a diversion program with your record.

    You are looking at thousands of dollars in fines. And since you are a repeat offender, possibly jail (which may be a good thing for you) .

    I could tell you plead Not Guilty, ask for a public defender.
    That will still cost you money.

    Well youre a lot of help and real friendly. I talked to a lawyer today and she doesnt expect me to get much. I've never been to this court so they dont know me like that.
    She told me to i could still get the diversion anyways. Thats what im going to shoot for still.

    I told it to you like it is. Hire that lawyer, but be aware that the prosecutor and judge WILL see your prior record. You will NOT qualify for a diversion program, no matter what that lawyer is telling you.

    I'am not trying to hire the lawyer, but she said I'd be fine without her. The court is more worried about murders and kick-doors than theft. The cop probably wont even show up. The juvenile record will not be showing up.

    You are wrong my friend. The DA has access to your record and especially if you are close to the age of 18, they can and will bring it up.

    Maybe you will get diversion, maybe you won't. The judge would be a fool to let you off a second time. Stop stealing. You have probably gotten away with it a bunch of times, but the more you steal the more you will get caught.

    Iam 20, and I was told it wouldnt show up. Things might be a little different in my area than yours. I've learned my lesson on stealing believe me.

    By the way, court went fine. I got deferred, no problem.
