    Default Statute of Limitations on Statutory Rape

    My question involves criminal law for the state of: Florida
    I need to know when the SOL stops if approximately four years ago a fifteen year old girl, now 19, was date raped. I have read some laws, but they are all so damn confusing and if anyone can just give a simplified answer I would really, REALLY appreciate it.

    How old were you when you date raped her?

    It matters.

    The EASIER way to figure it out is to know that the SOL doesn't even START running until the victim turns 18. Then, the SOL for MOST misdemeanors in FL is two years.

    BUT, statutory rape is only on the table if the victim was 16 or OVER and your own age was within statutory limits (which is why CBG asked YOUR age). If you are talking about someone having sex with a 15 year old in Florida, then you need to be expecting the state to charge with a FELONY, not a misdemeanor. Felonies in FL have a 3 year (or more) SOL, depending on EXACTLY what you get charged with.

    Excuse me, but date rape isn't usually applied to consensual sex which might open you up to statutory rape charges.
    Date rape would most likely be felony sexual battery.

    First off. I didn't commit the crime. I'm asking on behalf of the victim. And the rapist was 18 at the time.

    Then he's looking at a felony charge and lifetime sex offender registration - and he needs to be speaking to NO ONE except a criminal defense attorney.
