    Default Senior Citizen Rights Against Bill and Judgment Collection

    My question involves collection proceedings in the State of: Virginia
    I just left court and have a judgement for bad credit card debt and another pending. The judge told me to work it out with the plaintiff(collection agency) I have heard some horror stories about bank account seizures and the like. I have also heard that social security is protected and retirement accounts. My income comes from social security and from a trust fund set up by my mother for my retirement. Both checks are deposited in my bank account. My question is this,can they garnish my social security,can they garnish my trust and can they seize monies from those sources once they in my bank account? Thanks in advance

    Once money is in your bank account it can be garnished, although you may be able to (eventually) get it back if you convince the court that the money taken came exclusively from exempt sources. Nothing you have stated would suggest that distributions from your trust could not be garnished from your bank account, even if we assume it to be a spendthrift trust.
