Hi,
I won the diversity visa lottery and my husband is listed as a beneficiary on my application. Since we're already in the US, we'll be applying for an adjustment of status. The local USCIS office gave me two sets of paperwork - "adjustment of status for DV winners" for me, which is pretty straightforward, and "family based adjustment checklist" for my husband.
The family-based paperwork includes form I-864EZ affidavit of support, which should apparently be filed with an I-130 (however they did not give me this one). I'm not sure whether I need to include these forms in the petition; it seems that I would need I-130 if I already were a legal perm resident and my husband was still back in our home country. It seems that the family-based paperwork is just a generic set of forms to cover various scenarios, so maybe I don't have to file these two forms. Anyone knows?
Thanks a lot,
Adela
