    Default Denied Treatment for Job Injury Due to Omission on Doctor's Report

    My question involves workers compensation law for the state of: illinois

    make a long story short. i fell and injured shoulder and knee. however the er doc didn't place the knee it in the intinal notes and the wc insurance is denying my knee but accepted my shoulder. i went to my primary doc six months prior and complaned about the same knee but he took no xrays, no medicine and just said it was artiristis. i have never fell or injuried my knee until i fell. i ended up had surgery on both(only wc approved the shoulder). now wc is totally denying my knee and i seem to have a bogus lawyer that can't help me get my knee aprroved. my thing is why am i having these problems. my lawyer keeps telling me, oh we are still waiting on a settlement offer. please! my question is, if they are denying my knee why is my lawyer trying to get them to give me a settlement on it including with the shoulder? i wonder if we are going to have to go to trial and would that be a good idea? he's my second lawyer and i'm tapped out. i know no lawyer would touch it now...or is my lawyer working for me?

    If there is nothing to associate your knee pain with your injury - nothing in the accident report, ER medical report, or follow-up medical care - and the only diagnosis you have is that your knee pain results only from arthritis, you're not at all in a good position to get worker's comp coverage for your knee pain. Presumably your lawyer is trying to include your knee in the settlement because you want him to and because it may inspire them to make a larger offer - if you want to know what he's thinking, ask him.

    i injured my knee during my fall..i tore my kneecap..i had to have surgery to correct it...i'm not trying to get him to include nothing...it's an injury that they are disputing...
