    Angry How Long Will Somebody Go to Jail for Serious Domestic Violence

    My question involves criminal law for the state of: Idaho

    With due regret my brother has a history of domestic voilence. The most time he has spent in jail in 6 months.

    However, he showed up to his girlfriends place last night, bashed her head in and strangled her to the point of almost passing out. She recieved staples in her head and is at home resting.

    He has been charged with Felony Domestic Battery and Felony Attempted Strangulation.

    What is the sentencing length for the state of Idaho?.... max sentance for a repeat offender.

    Unfortunately, not life.

    ASSAULT AND BATTERY
    18-923. Attempted strangulation. (1) Any person who willfully and unlawfully chokes or attempts to strangle a household member, or a person with whom he or she has or had a dating relationship, is guilty of a felony punishable by incarceration for up to fifteen (15) years in the state prison.
    (2) No injuries are required to prove attempted strangulation.
    (3) The prosecution is not required to show that the defendant intended to kill or injure the victim. The only intent required is the intent to choke or attempt to strangle.
    (4) "Household member" assumes the same definition as set forth in section 18-918(1)(a), Idaho Code.
    (5) "Dating relationship" assumes the same definition as set forth in section 39-6303(2), Idaho Code.

    Looks like 15 years for the attempted strangulation.

    (2) (a) Any household member who in committing a battery, as defined in
    section 18-903, Idaho Code, inflicts a traumatic injury upon any other
    household member is guilty of a felony.
    (b) A conviction of felony domestic battery is punishable by imprisonment
    in the state prison for a term not to exceed ten (10) years or by a fine
    not to exceed ten thousand dollars ($10,000) or by both fine and
    imprisonment.

    And 10 for the FDB.

    Thank you! I was gathering it would be hefty. Hopefully he will come to his senses with the time he will be spending. Sad but true I personally felt he has gotten off easy with the other things he has done. I am hoping they aren't easy on him this time. Maybe this will be a wake up call for him.
