    Default Schedule Change Due to FMLA Absences

    My question involves labor and employment law for the state of: wisconsin. Can my employer change my schedule based on a trend in the days of the week I choose to use my intermittent fmla leave?

    Meaning what? They see you tend to use FMLA on Tuesday so they schedule you off that day and on another day? Unless you have a contract guaranteeing a certain schedule, they are free to schedule you as needed. If they know you are going to call FMLA on a day, why not schedule someone else to work it? Saves you the bother of calling in and them the hassle of finding someone to fill your shift.

    I hardly doubt this rises to any kind of discrimination b/c of FMLA.

    Actually the compliance guidance requires YOU to work with your employer on the scheduling of the intermittent leave to minimize the impact on the employer.
    This would seem to be legitimate.
