I signed an employment agreement in December of 2004 that included a non-compete clause. The agreement was for one year and had a stated expiration date of December 2005. The expiration date came and went and my work went on as usual, i did my work and I was paid. I am now considering leaving the company and recently reviewed the agreement and noticed that the expiration date had passed.
My question is if the non-compete is still enforcable since the contract has expired.
Here is the text from the expiration text in the contract:
"I acknowledge that I have received a copy of the 2004-2005 COMPANY Compensation Plan effective December 9, 2004, and that it is valid until December 8, 2005. I understand that it is my responsibility to read the Plan and that I should contact SUPERVISOR if I have questions or need help in understanding the information contained in the document."
