    Default Case Law for Marijuana Staying in Your Body More Than 30 Days

    My question involves criminal law for the state of: florida
    can anyone point me to any such thing? i need something to bring to court to argue against a probation violation due to marijuana staying in my system longer than 30 days and don't know where to look. what should my stance be as i am looked at as the guilty party in this situation. i'm sure it's been argued before somewhere and resulted in an agreeable ruling, thanks for any help

    There is no statute.

    You need medical evidence...perhaps the hiring of a medical expert to testify on your behalf.

    What exactly are the circumstances? How heavy are you? How often do you smoke?

    well, i was a heavy smoker,every 2 hours or so everyday,prior to sentencing due to that being my choice for pain relief for severe back pain from an injury.haven't touched a bit of it since sentencing despite my ongoing pain.i am 6'4", 320 lbs and have always had a slow metabolism. i told my po at our first meeting that it was in my system and am on record at sentencing telling the judge that it was present in my system also.i have not been deceptive in any way and have undergone a substance abuse eval as per the court and am attending the classes they assigned to me.i was sentenced on the 25 of febuary and was just tested for the first time on the 11th of april. my po seems to just want to lighten his caseload and won't listen to me about it
